Probate/Administration of Estates (Non-contested):

It may sound like a lot of information to take in but at Howard & Over we guide you every step of the way – so don’t panic! 

We offer a fixed fee price for obtaining a Grant of Probate on your behalf which are:

Where no Inheritance Tax is payable and no IHT400 required - £950+VAT and disbursements
Where no Inheritance Tax is payable but an IHT400 is required - £1,250+VAT and disbursements
Where Inheritance Tax is payable - £1,750+VAT and disbursements

In each case to obtain a Grant of Probate the Probate Registry fee would be £273 plus £1.50 for each copy of the Grant of Probate required.

Our charges for the administration of estates are dependent on the number of assets within the estate, the number of beneficiaries, whether or not tax is payable (and any reliefs required to be claimed) and complexity of the assets within the estate. A fixed fee quote can be given for each individual client however a typical small estate containing one property and a small number of bank accounts with a valid Will, no more than 3 beneficiaries, no disputes or claims against the estate and no Inheritance Tax payable would cost between £1,500-£2,500+VAT and disbursements to fully administer, this includes obtaining the Grant of Probate, collecting and distributing the assets. 

This sum does not include conveyancing costs in respect of the sale of the property or any disbursements. Disbursements are costs related to your matter that are payable to third parties, such as court fees. We handle the payment of the disbursements on your behalf to ensure a smoother process. Disbursements that may be payable in relation to the administration of an estate include a HMCTS Probate Court Fee of £273 + £1.50 per copy of the Grant, bankruptcy charge search of £2 per beneficiary, £200 (approx.) for statutory notices and property valuation fee of £300 (approx.).

Charge out Fees for Fee Earners:

Unless we have agreed otherwise, our charges will be based on the time spent on your matter, applying our hourly charging rates as applicable from time to time. Time spent will include meetings with you and perhaps others, considering, preparing and working on papers, correspondence, and making and receiving telephone calls. 

We reserve the right to charge separately for photocopying, printing, telephone calls, faxes, electronic funds transfers, catering and other support services, and travel, courier and other incidental expenses. 

Where applicable, we will charge VAT on our charges and expenses. We will charge you for each hour of work by in accordance with the below table. Please note that the current hourly rates of our solicitors and executives are as follows:

Referral Fees:

Occasionally, clients are referred to us by a third party on a commercial basis and therefore we may pay the person referring the client to us a set fee. On such occasions, the client is given full details of the sum that is payable to the person that has referred the matter.  Our costs that are payable by the client would not alter from the standard fees that are listed.
