Vexatious employment tribunal litigants - How to deal with employees who keep firing in Employment Tribunal Claims without merit? You can either apply to have each claim struck out with or without a warning for costs to be applied against them. For more peristent persons you may wish to consider a Civil Restraint Order (CRO) in the High Court with either a limited power to cover particular proceedings or a general power to stop the litigant bringing claims without the permission of the court. There is also a power to apply to the Employment Appeal Tribunal for a Restriction of Proceedings Order (RPO). However, the CRO and in particular the RPO require more time in the courts and therefore money although they are more effective in the long run if an employer keeps coming back for more. Take legal advice and consider your options.
