From Zero to Hero - Zero Hour Contracts

Friday 2nd August 2013

From Zero to Hero - Zero Hour Contracts - there has been a buzz in the media about zero hero contracts and their abuse. There is no official definition of the zero hours contract. In fact it can range in substance from a very casual arrangement where there is no obligation to offer or accept work to the other extreme of an obligation by the employee to accept any work on offer but with no guaranteed minimum hours. Whether a worker will enjoy employment rights will depend on the precise nature of the working relationship and day-to-day practice. Also there may be issues as to a worker's status and whether they can bridge the gaps in law between each assignment in respect of continuity of service. Tribunals are likely to take a very close look at unusual or one sided contracts to ensure that they are not a sham hiding an employment relationship.
